False Advertisement?

Hi,





So I ordered a Christmas gift from a popular electronic store online. When I visited their homepage, they advertise an offer specifying that all orders should arrive before Dec. 24th or they'll send me a digital coupon that takes off a certain amount of money from my next purchase. Well the gift I ordered from them didn't arrive til' a couple days after Dec. 24th. So I emailed the store representatives asking how I would receive the coupon and they responded by telling me I'll get it the next day. However I never received it. So I emailed them another time couple weeks later and they didn't respond. I called them and no one answered. The third time I emailed them they said they'll send it to me as soon as possible. However, it has been a week and I still haven't received it.





So I was wondering what I should do? I know I'm not losing anything. I'm just angry that they used an incentive to get me to order from them, but when I did they won't send me the coupon.

Call your local Mayor Hotline or you could try the Federal Trade Commission (I think this one). Go to their website at www.ftc.gov and it should list all kinds of things. There's also Federal Calling Commission but that pretty much governs calls and such.





The Better Business Bureau doesn't do a whole lot really. It just lodges a complaint against the company but as far as getting a resolution, you probably will never get one through the BBB.False Advertisement?
Find out where they do there business and call the better business bureau on them . If you google the better business bureau of each state and you could probably get some contact information on one of them.

Are advertisement products on T.V true or false?

Depends on the product. If it's an informmercial touting get rich quick with real estate, it's probably false. So many people think they can relieve their problems and pay a little money to get a course to get back on top. Watch a few for laughs. Then use yahoo and type in that course along with the word ';scam';. You'll see how many people got taken.





If it's a food commercial, it might be a bit of hype but you'll probably get exactly what you see on tv. Although everyones taste buds are different. You may love that new low calorie salad dressing but everyone else hates it.





If it's for some gizmo or gadget, then you have to realize, it works well on tv because they've done it 50 times and only used that footage showing it worked GREAT ! There are also sites you can search on Yahoo about ';as seen on tv'; sites where consumers rate the product good or bad.





Judge for yourself but always research research research before you try anything out ';as seen on tv ';

Soldiers fight for peace and freedom. Unfortunately, sometimes war is needed for the benefit of people in the long run. I think some wars are justified, I think some aren't. For me their can be no argument.
Although I think arguments can be made that it is and is not, my experiences within my country leads me to believe it is not. I think our collective society has become vengeful and fearful and images of soldiers graves and reminders of fallen soldiers do not provoke the same sentiment they did in the late 60's and 70's. I believe our culture has become quick to find the ';evildoer';, and allow our government to punish those we are told are to blame for making us feel unsafe. I think the graves statement may actually feed the collective fear that people live with, as well as insight people to continue fighting because they can not accept the soldiers died without tangible outcome, like ';winning'; a war.

It is any form of advertising that proves to be untrue.

Most of viral ads can be called false, especially if they contain something indecent, violent, dangerous etc. - so the client would never admit it was done under his permission. They usually say those ads are done by the fans of the product or the brand.

    recently purchased a car and I specifically asked about 0% financing for 60 months. However, it was communicated that it was unavailable. I recently received a flyer in the mail stating they have 0% financing for 36 to 60 months on my specific vehicle (FYI I qualify for the rate). However I already purchased the car, and the deal was valid when I purchased the car. I contacted the manufacturer and they said I would have to take this up with the dealership I purchased the vehicle from. I am not getting any help from the dealership.. Do I have a case here? and what should I do?

    i doubt if you have anything. Ads regarding financing are full of weasel words. Perhaps the truth of the matter is that it was not available to you, but could have been available to others. Consider also that the ';false advertising'; you mentioned was not received until after the deal was done, so it could not have affected your decision. Your complaint seems to be that no one offered you o% financing, when they could have. No one has to make an offer to you and you were free to walk away if you didn't like the terms.

    False rental advertisement?

    I just rented a house. The owner informs me now that the garage is his cousin's home as well as his parents. I am paying for the utilities for all of these people which is also not a part of our agreement. This was advertised as ';A 2 bedroom private home with a pool';. He now says that the backyard is theirs since they cant stay in the garage all day. I cant park in the driveway, and since there is only 1 mailbox I have to wait for them to check the mail before I get mine. (they will give me my mail personally) I am really in a fix. I need to know what my rights are since I have already signed the rental agreement (prior to him telling me about the utilities and my 3 amigos in the garage). I have paid a lot of money for this house and doubt if he has it to give back.False rental advertisement?
    Take his azz to court. If you have all that in the rental agreement and/or a copy of the advertisement, use that for evidence this was under false pretenses to defraud you. As soon as he is served his subpoena to appear in court, he may let you voluntarily out of the lease.





    If you do not have the advertisement, go to the newspaper and get a copy of the newspaper the ad ran in.

    do you think most products are false in their descriptions? for some reason i always come upon that discovery. whenever i buy bodywash or soap that says its supposed to moisturize my skin, it always leaves it dry and gross. whenever i buy products that say they will make my hair soft and shiny-they don't. i buy shaving cream that says it will prevent nicks and irritations and will make my skin smooth but i still get razorburn and my legs itch after shaving. i buy products that are supposed to be 'good' and are somewhat expensive. anyone has encountered this problem or has any idea why these products never live up to their promise?False product advertisement?
    Its a very rare product indeed that lives up to


    its claims. The reason: Money.


    When it comes to consumer products like soaps,


    shampoos, creams, etc., the truth is that every product is pretty much like every other one. They


    usually do a fair job, but most of what you are paying for with a product is the container and the marketing cost. The actual raw material costs are


    inconsequential for most of these products. And


    what are the raw materials? The cheapest possible things they can find. In fact, the term

    They are really selling dreams in a bottle. And boy, people are willing to spend almost anything on that!     How to fight back? Check out independent sources that compare products side by side, such as Consumer Reports. Rely on word of mouth, or actual consumer reviews. Don't buy into the hype.

    Okay so tonight for a second I lost my sense. And may I remind you i'm using this as an example. I saw a magazine with Kristen Stewart and Robert Pattinson on it saying they were a couple. They had on it ';Were already like a Married couple';. It was trying to make it look like they were interviewed. Well I usually don't read these magazines and i'm not obsessed with them but I wanted to see what it had to say. So I bought it for $3.49. I get home and I read the article and it says ';A source says the couple can't stay away from each other';. So Kristen and Robert were not interviewed, but they made it look like they admitted to being a couple. I just got and angry because it was all CRAP! Of course they could be dating, but I never believe anything unless it comes from the stars. So I was thinking this was true since it looked as if they were saying it. So wrong. It pisses me off. Why? Because they can sell a magazine with complete lies in it! It's stupid. And yes I was stupid to buy the stupid magazine. But hey were human. But no more! It's bull crap! And don't say they are dating or whatever. Its not the issue of ROBSTEN or whatever. it's the issue that it's stealing!How is it legal to be able to sell Magazines with complete lies in it? And false advertisement?

    When they wrote that they can't stay away from each other, that's actually true. But anyway, i agree with you. Not because of that story, but others. It's sad that people get to waste their money on SOME magazines that have bull in it!!

    Technically, people can sue for false advertisement. If they get the idea that there's something in the magazine that there actually isn't, it's not right. But who would go to court over such a small case? And the press can defend themselves. If they don't state that the celeb said it, such as, ';'we're already a married couple,' Kristen said. etc. etc.'; then they're okay. It's just one of the lessons in life that you can't believe everything you read and hear.


    Oh yeah, and don't always trust pictures as well. It's ironic that I bring this up, but in a KISS mag they showed a picture of Kristen and her actual bf, and then the same picture with Rob's head on it. One word. Photoshop.


    Anyway, you'll just have to trust your own judgement for things like that.

    Advertisements are not generally considered offers to contract. They are generally seen as invitations for you to make an offer. Unless they are highly specific on quantity available and other details, your case would likely be dismissed. It might seem unfair, but think about a company offering cars for $1,000. If they only have 50 cars and 100 people show up, it would be unreasonable to allow 50 people to sue them. I know this isn't what happened to you, but that's just kind of the legal reasoning behind it.





    False pretenses would mean they not only advertised it, but told you it was available specifically to you. Since the contract you signed pretty much says the opposite you likely don't have a case. Like I said advertisements alone are generally not offers legally.

    If you could some how prove that they did have 0% available to you, even though they said they didn't and you signed a contract that did not include it you might have a case. This would be hard to prove. If you want to try and you really want legal advice call a lawyer.

    I see your point, but the fact remains that you ended up agreeing to whatever the finance charges ended up being on your contract. You could bug the dealership or the finance company, but I doubt it will get you anywhere.

    I have been to the SE and seen Randy and Angela P (high-stakes)...I was told they are there every day...There is now a billboard out by Frandor in Lansing of Randy...I have been going for 20+yrs and have seen alot of people come and go, lose everything...very dangerous...IRS will love them!!!

    I am a musician, and recently I bought this program which stated it would send me approximately x amount of friend requests to better promote my music on myspace. There were 3 different deals they had





    $9.00 for an approximate 400 friend requests, for one day


    $43.00 for an approximate 2,000 friend requests, for one week


    $105.00 for an approximate 5,000 friend requests, for one month





    I bought the deal for 2,000 ($43.00) friend requests for a week.. Well my week is almost up, and I have only received 30 friend requests, and I am not even sure that they were all from this..





    I have not yet accepted or denied any friends requests, so in my inbox for the requests are still there.. Do I have a legit case if my week is over, and I don't even receive 50 friend requests, when I could have bought the feature for $9.00 which stated I would get more? They did state that theses approximates are by no means a guarantee and can vary.. So do I have a case, or am I just screwed?Would this be considered false advertisement?

    Because they said they don't guarantee results - I hate to say it - but you're screwed. If they had a money-back guarantee, you'd have a valid complaint against them and could request a refund.
    I'd say it's not just false advertising, it's breach of contract. But you would have to look more closely at the terms.

    Is this false advertisement?

    i purchased a baby furniture set online that consisted of 3 pieces. the picture shows them and directly below it states what i get (crib, changer, 4 drawer chest). it's obvious what the crib is, and the 4 drawer chest, and then there's the last piece of furniture that has 6 drawers with a changing pad on it in the display. obviously that's the changer. well, part of my order came in today and instead of the changer that was pictured, it's a tv stand! why on earth would i need a tv stand in my baby's room. they state that this is their changer, however, that's not what's picture. is this false advertisement and if so, what should i do about this?Is this false advertisement?
    Did the fine print state that the furniture you buy may be different from the photos? That might be their way of getting away with it. However I would complain and try %26amp; get my money back or the changer in the photo. If all fails report them to the Better Business Bureau and other websites that let you leave a bad comment about the company.     This may have just been an accident that they sent you that just contact the company and tell them about what you recieved tell them you would like to send the stand back in exchange for the changer but dont send it til you recieve the changer. i order things all the time and once in a while they me the wrong thing I send it back after they have sent me the correct item

    I've been trying to get an auto loan and decided to use Yahoo Finance (because my credit isnt so great). If you go to Yahoo Autos and then click the FINANCE tab theres a gray box area that offers auto loans for people with bad credit. And it specifically states 'Lock in a low rate today, check on rates with our partners.' Seeing the word 'partners' i felt that it was safe enough to sign up with www.driverapproval.com. Has anyone ever dealt with www.driverapproval.com? I found a lot of articles referring individuals with bad credit to use that website but no hard information. (Stupid me!) I was supposed to be contacted within 24 hours regarding my application and its been 2 days. I am beginning to freak out because all my information mightve fallen into the wrong hands! I emailed yahoo fraud and they responded saying that 'the seller misinterpreted their affiliation with yahoo'.





    which leads me to my second question..

    They're fully booked, that's what I heard. In any case, they should make an announcement pretty soon and inform their customers that they won't be receiving anymore bookings. It's the most viable thing do in the circumstances; it's their duty to be transparent to the buying public.

  • What rights do I have as an online buyer and a false advertisement?

    I ordered a tv from wally world and paid for it and they are shipping it to the store. It hasn't come in yet. When I bought the tv, the online description said 52'; 1080p plasma LCD HDTV and had loads of features. Now the online description has changed to 50'; 720p plasma and has lost a few features. When I paid for the tv I printed off a copy of the page that shows a picture of the tv with the description and features and price.





    I have been looking for a tv for almost a year and purchased this tv even though I am waiting quite a while for it to be delivered. The price was good for a 1080p 52';. But it is not good for a 50'; 720p.





    Are they legally bound to give me a 52'; 1080p television since that is was they advertised? I need to know what ground I have to stand on before it gets to the store.What rights do I have as an online buyer and a false advertisement?
    Definitely bring along that copy you printed out. Walmart will most likely be more than willing to give you a refund on the purchase price if the product is not as advertised. Usually Walmart is fairly good with returns, but it's very surprising the description changed so much!





    If at Walmart they tell you that you can't get a refund (or the proper set), then you definitely have a case... I mean buying something from their store online should have the same effect as buying something in-store. If you buy a toaster in store as advertised and realize that it's an entirely different color, different model, and different capacity when you open the box... you have a right to get a full refund for what you just paid for.





    Be sure to check the fine print on Walmart.com's terms of service agreement. I don't think it justifies false advertising (or even a computer error which this very well may be). If you're really very concerned about it and want to know Walmart's position on this kind of matter, they do have contact information.     make a copy of the page you printed and take the copy to the store and if the TV isn't what you ordered then refuse to buy it. When order something if it doesn't come in the way as described, then they can't expect you to buy it anyway.





    Glad you printed off a copy, that was a WISE thing to do. We have to protect ourselves.
    In English law, (you'll have to check your own) you could demand the 50'; TV, and if they cannot supply it you could buy one and sue the store for the difference.





    AS LONG as you a receipt with the 50'; description.
    That is bait and switch . . I am not a lawyer . . but I wouldn't stand for it. If they won't help you out (which I think they will). I would call my credit card company and dispute the charge.

    Printing it was a good idea, also having your receipt that states exactly what was purchased is good to have as well. Be sure to check that you are getting what you paid for.

    Can i get out of my lease due to false advertisement?

    When I signed the lease, the agent said that were was a restaurant and workout room in every apartment, they advertise (on their website too) that its a gated apartment complex with 24/7 gatehouse attendant.





    There is no restaurant, it is gone, appartnely gone before we even signed the lease (without our knowledge). There is no work out room, as advertised that there is a working room in every building, there isnt in ours. One enterance is gated with 24/7 doorman, the other isnt, the gates are always open with no one watching it, anyone and everyone does get in from the side.





    and then little things, like they advertised tennis courts, but theres no nets and the ball doesnt bounce on the courts. and they said theres a stamp machine, and its gone.





    Weve been calling/emailing and going inperson for weeks to get a copy of our lease, they said they would mail it, they never do.

    You may be able to get a reduction in your rent. Did you tour the complex before you signed the lease? If all the things the complex promised you are making a large difference to you, then by all means ask them to break the lease. The only thing you could sue them for would be to dissolve your lease.
    Move out if you don't like it and it was false advertisement. Tell the owner and tell them why. They should understand. If they say no, then say F.U. I want my deposit back. If they still say no, tell them that they will be hearing from your lawyer, which will cost A LOT more because they will charge the owner legal fees....that usually does it.
    First, I'd talk to them. Either they will allow you to break the lease, or get a reduction in rent. Sounds like the place is not well maintained, so make sure you document all the problems with the place in writing and pictures before you are there too long. Most tenants don't bother doing this, but they should.





    Make sure you document all these things before they have a chance to remove it from their site. Were these things listed in the lease? If so, you definitely have a case. Otherwise, you'll end up going to court to get your deposit back and sue them for some sort of compensation.

    Okay, so I basically ordered a fake G1 from this website that is based in China. When I received the phone, it was, indeed, not a G1 and some lame replica. It does not have a keyboard, android market, or access to internet, although I have a data plan with T-Mobile currently. Basically the only thing I could do on it was call people, because the texting was messed up too.





    On their website, it shows a picture of a legit G1. Only until after I bought the phone and went back did I realize a tiny link that had other pictures of the phone. Even then, it looked like a G1 to me and the phone even said ';T-Mobile'; at the top. The phone I received says ';G-Mobile.';





    Also, they are making it very difficult for me to return it. I have been arguing with them via email for over 2 weeks, and their English is not very good. They are telling me I can't return the phone if there's nothing wrong with it.

    I've been trying to get an auto loan and decided to use Yahoo Finance (because my credit isnt so great).     Car dealers do it all the time, ever heard ';Good Credit, Bad Credit, No Credit? No problem!! Bring $99. and drive away!';??? You'll never find anyone with bad credit drive off a dealers lot in a brand new car with only $99 down, I promise you. But they hide the details in fine print so small that you need a microscope to read it.     Verbal agreements rarely mean diddly, unless you can back up what they told you with a voice recording of what was said.

    So that same day I saw a Burger King commercial and I thought it was pretty funny, it was the one with the whopper jr and his father, so I kind of remembered it. But in the commercial it said the burger was only 1 dollar. However I noticed the other day when I entered a local Burger King that it was actually $1.19. Isn't this false advertisement? Not that I'm going to try to sue BK but when you think of the amounts of people who buy whopper jr's everyday thinking their a dollar BK must make millions out of it. I mean supposed with taxes its 1.07, you multiply the the 12 leftover cents by lets say, 1 million burgers a day. That's a lot of money. I just found it amusing and also interesting how such a big industry could make such a stupid error.Isn't this a case of false advertisement.?

    I am military living in Colorado and wanted to purchase a vehicle from a dealership that i seen online. I wired the dealer $1000 and called him about 1hr later letting him i know i just sent the money. My wife wanted me to confirm with him about it having a sunroof. I told her yes, but still asked and the dealer replied no!





    I asked for my deposit back and he said sorry bud. I went home asking myself what made me think it had a sunroof. So i looked online and confirmed that it said sunroof on their autotrader ad. I called the dealer back and he informed me that it was human error and that it also says on there no refunds of deposits. To this day i havent signed any paperwork, whatsoever.     The dealer is in violation of the law. ALL deposits are refundable. It doesn't matter what you put it on, it is fully refundable. Sometimes a shady dealer might try to get away with it by calling your deposit a down payment, thinking the phrasing will allow them to keep your money. But that's not true.





    A deposit is any type of payment made for the explicit purpose of a future purchase. Your deposit is 100% refundable. Also, you put the deposit on a vehicle with a sunroof since that's the way it was advertised. But they don't have that specific vehicle. Therefore, they owe you your deposit in full.





    Don't call anymore. You now need a paper trail to prove your case. You need something in writing that can be introduced as evidence should you have to go to Small Claims Court.





    Send the owner a certified letter stating that you want a full refund of your $1000 deposit within 48 hours of receipt of the letter. Or you will file against them in Small Claims Court. Be sure to get a Delivery Confirmation on the letter too, so you can track it to be sure it was delivered.





    If they don't respond, file a claim against them in the county from where you wired the money to them. If you file it in any other county, your case will be thrown out on a technicality.

    You were very foolish to send money for a car you have not driven and inspected in person. You should be able to get your deposit back only because you have not signed any actual papers. If they balk at refunding the deposit, tell them you will be in touch with the Licensing Department (which issues their operating permit) and the State Attorney general. If they don't pony up the cash, follow through with the calls.
    It would be a small claims matter in court. You will probably not get anything unless there is proof of you giving the money like a transaction number and proof of their false advertisement.     If the coupon was as crystal clear as you describe, the cashier or manager you had seems to have misunderstood it (don't ask me how). I'd bet a dollar that anyone else, at that location or any other, would have honored the coupon.





    So on that point, because the coupon was issued by Burger King and is apparently quite explicit, you couldn't sue them for false advertising. You can complain to the company about what happened at the restaurant, though, and you'll probably score some more free food out of it. Do it in writing and be polite, and you'll get a good response.     I would think you need to do some homework and get this ';48hrs guarantee'; either in writing from that company or a recording of a sales person promising this 48hrs turn around.





    Mind you I'm not a lawyer. I'm an insurance agency owner, so I would suggest you see an attorney to explore your options. Given the costs I would think ';small claims court'; would be the best thing for you.

    Private Car Sale, Buyer says False Advertisement.?

    Earlier in the week (3 days ago), I sold an older car (1986). Today (3 days later) I received a call from the buyer saying there are problems with the car.





    He is saying that there is engine problems (but agreed I didn't know about it), and false advertisement because I had listed in my craigslist ad that the car had a posi rear end in it (which I was told it did when I purchased the car 2 years ago). I'm no mechanic so that's what I thought it had.





    He is basically saying that he wants $500 back from me because of false advertisement and that's how much it would cost to find a cheap posi. He originally said he wanted $800 back.





    Now he paid me $2900 and never asked to have the car checked out by a mechanic before he purchased the car. If he did and offered me $2400 I would not have sold him the car. I said I felt bad and would be willing to give him $200 back, but he said that he is getting $500 or will take me to small claims court.

    What I always notice, and it annoys me so much, is that businesses constantly misadvertise. Once I looked for a used car. The dealer advertised a price for a car that seemed really good. I called and they said, yes, we have it. When I was there they of course did not have it, but had an older car of the same model with more miles for almost double the price.





    The issue I have is that these businesses constantly advertise like that. There are even businesses that offer you products they do not even have just to get you in the door. How can such business practices be legal and why isn't anyone doing anything against that?Is there a law against false advertisement?
    Yes there are laws. But you have to prove that the merchant intended to deceive you through the advertisement. That can be hard to do.





    You can always take the business to civil court and sue them if you think you have a case. Some Atlanta apartments used to be famous for what I call false advertising. They would run a newspaper ad for a two bedroom with washer/dry connections for a low price. The ad would be in the Sunday paper and I would get there as soon as the apartment office opened on Sunday afternoon. Every time, the ';low price'; unit had already been rented, but they had many other units at a much higher rental price.





    I wrote a complaint to the newspaper (The Atlanta Journal/Constitution) and even called them and complained.





    But the same apartment complex ran the same ad every Sunday.

    I was looking for a golf school to attend and searched Google under the key words Golf School and Golf Schools. I ran upon an ad that read';Top Ten Golf Schools';. I reveiwed the articles written there to later find out that the website was owned by the same golf schools listed as Top Ten. If you booked with one school listed there, you were enrolling with all of the other schools listed there because they all the same.





    I confronted the owner and he finally confessed that it was a marketing technique that he was using to dominate the search engines and obtain the business by not allowing clients to search the other schools advertising on Google. He also told me that they were not real golf schools but they were kind of a travel agency refering clients to the courses.





    I then booked with Executive Golf School and discovered what a real school was. These people had PGA pros with over 16 years of experience who tailored lessons just for me.     I am not sure if I have a case or not, but this school seems a little sleazy. I paid for a 3-week makeup course at a so-called ';academy';. I had to pay for tuition, and had to buy an expensive makeup kit that I would need if I was hired.....even though no employment was ever guaranteed. The word ';academy'; is included in their name, so I expected this course to be part of a licensed, bona fide ';academy'; with licensed, bona fide teachers. I found this course to be very unprofessional and amateur, and dropped out of it, after realizing it was a waste of time and money. This place is simply a makeup store, but they want to make more money by also marketing themselves as an ';academy';.     Here is your issue... you did not do your research. You want to check before going to school that the school is accredited and that you will recieve a license when you are done that is recognized in your state. Some schools make up their own accredidations too so it is hard to flush these out. Did you speak to anyone before starting? Did they misrepresent the school to you or did you just assume from the word accademy that it was a school? You can ';learn'; something from anyone you meet... and you should learn something from everyone you come in contact with... but that does not mean that you will have a license to do the work... get my drift? I have a feeling that you have no case because of your own lack of research. Im sorry hun... this is crappy but there are dishonest people out there, and you may just have found some of them.

    Private schools (of any subject) do not require licensed teachers. In the case of an academy, they may be required to be licensed cosmetologists.





    You should have checked on their license and reputation before spending your money.
    Check with your local or state government. Typically, secondary or vocational schools are licensed and certified by the state.
    Being an ';academy'; is a lot easier than being ';accredited';. That's the word you should have looked for.

    I bought a car last night and in the ad it states a lot about the car includeing leather seats and NEW TIRES. which it didn't have the leather seats which I told he guy I would over look.     Car Dealership wont refund my deposit...false advertisement?

    I am military living in Colorado and wanted to purchase a vehicle from a dealership that i seen online. I wired the dealer $1000 and called him about 1hr later letting him i know i just sent the money. My wife wanted me to confirm with him about it having a sunroof. I told her yes, but still asked and the dealer replied no!





    I asked for my deposit back and he said sorry bud. I went home asking myself what made me think it had a sunroof. So i looked online and confirmed that it said sunroof on their autotrader ad. I called the dealer back and he informed me that it was human error and that it also says on there no refunds of deposits. To this day i havent signed any paperwork, whatsoever.     The dealer is in violation of the law. ALL deposits are refundable. It doesn't matter what you put it on, it is fully refundable. Sometimes a shady dealer might try to get away with it by calling your deposit a down payment, thinking the phrasing will allow them to keep your money. But that's not true.





    A deposit is any type of payment made for the explicit purpose of a future purchase. Your deposit is 100% refundable. Also, you put the deposit on a vehicle with a sunroof since that's the way it was advertised. But they don't have that specific vehicle. Therefore, they owe you your deposit in full.





    Don't call anymore. You now need a paper trail to prove your case. You need something in writing that can be introduced as evidence should you have to go to Small Claims Court.





    Send the owner a certified letter stating that you want a full refund of your $1000 deposit within 48 hours of receipt of the letter. Or you will file against them in Small Claims Court. Be sure to get a Delivery Confirmation on the letter too, so you can track it to be sure it was delivered.





    If they don't respond, file a claim against them in the county from where you wired the money to them. If you file it in any other county, your case will be thrown out on a technicality.

    You were very foolish to send money for a car you have not driven and inspected in person. You should be able to get your deposit back only because you have not signed any actual papers. If they balk at refunding the deposit, tell them you will be in touch with the Licensing Department (which issues their operating permit) and the State Attorney general. If they don't pony up the cash, follow through with the calls.
    It would be a small claims matter in court. You will probably not get anything unless there is proof of you giving the money like a transaction number and proof of their false advertisement. THis matter would drag out for years and happens alot but youd be spending more money taking it to small claims court than the money you lost...my advice is dont send money to anyone unless you have a signed paper or a refund policy

    I moved into some apartments with my husband and my 2 year old daughter. Shortly after, I got pregnant and now have a 5 month old baby girl.





    When we first moved in here the ad said that there was a fitness center here. In which there is not. (Important to a Mama with 2 kids that needs to get rid of that extra baby weight and can't travel far with the kids and still work out) It also said that it has a heated pool. (also important for the enjoyment of babies swimming)





    Since living here a lot of things have changed. We used to be able to have BBQ's and then they made us get rid of them. We weren't even allowed to store them on our private patios, we were forced to throw them away. That's alot of money! We also use to have a car wash and they have taken that away from us as well. They said it was to conserve water, but lets get real they water the grass 2-3 times a day in the middle of the day, everyday!





    Oh, and when we looked at the apartment they said our apartment had washer and dryer hook ups, to our surprise there is no hook ups and the laundry facility that they do have are always broken. I have called maintenance several times. it is going on 3 months now and they still are not fixed.





    Sorry...one more thing. They also had trash service when we first moved in, and once again shortly after to that service away too.

    I would go over the contract and discuss it with a lawyer as well. Try finding something that you can charge them with. Also try talking to your neighbors, usually they would be feeling the same thing.What is considered false advertisement for apartments?

    The BBQ removal is likely a fire/safety hazard and insurance issue. They did not force you to throw the BBQ out, they required you to remove it from the property. It was your choice to throw it out.





    If they told you the apartment had washer/dryer hook ups and the apartment does not, again, you accepted the apartment that way. Unless your lease states that washer/dryer hook ups are included, that issue is moot as well.





    The trash service and broken laundry facilities are valid issues. You need to send management a letter (certified, return receipt requested) about these issues.





    When your lease is up ... move out.

    Labor Day sale ad for a furniture store states that a specific piece is 50% off the price they have listed is $399.99 with a regular price of $799.00. There is no notation any where on the page that there are conditions to the 50% off. But when we call the store to find out if they were in stock we were told that we had to spend at least $4999.99 in order to get the sofa for 50% off. We finally found the fine print on the bottom of the back page. But it still does not any where on the ad say that the sofa is not $399.99 unless you spend the other money. It specifically states that it is 50% off. I know that I am just angry, but I am really tired of the consumers (us) getting taken advantage of! How can I get the sofa for the advertised price?What constitutes actual false advertisement?

    Well if they do not have any of the mentioned ';double chance'; items and never did, then it may be considered false. There is also the chance that they were out, and more were being shipped.





    Although if it really mattered to you, you probably should have mentioned it to the cashier/manager while you were there.

    I live in Lafayette, Indiana. When the pick 5 for 5.95 was first introduced at Arby's the mozzarella sticks were on the menu. They then came off of our pick 5 for some unknown reason. Then the price went up to 5 for 6.95 which seemed horrible (probably because they ruined the alliteration). Anyway, I was super excited to see the Arby's commercials on television advertising the Pick 5 for 5.95 was back and so were the mozzarella sticks.     Usually at the end of a commercial they say at participating locations only. That location may not be participating with Mozzarella sticks!
    Sorry dude they get around the bait and switch by saying on the ads prices and participation may vary. meaning it might be there or it might not.
    They don't have them here either.
