we have been trying to buy a home and all these places say we guarantee it if you own property or you can afford the payments.we are in both categories.all they do is run your credit till it is way down.are they legally allowed to advertise as guaranteed or is that considered false advertisement?Why are businesses allowed to use false advertisement?
They usually say ';guaranteed to qualified buyers'; or it is in the fine print. Legally they can say pretty much anything, it is the old Buyer beware kind of thing.Why are businesses allowed to use false advertisement?
A guarantee is a form of false advertisement but you have to be able to read the fine-print that get's them of the hook. Companies like that usually have a disclaimer is very small fine print that would get them of the hook in any case. That is the first thing you read in any advertisement.

All advertisements have conditions attached real implyed or inferred.

as such such advertisements ALWAYS have conditions and fine print that covers themselves in the event of any legal action / and or challenge to such guarantees, you just have to be simply aware that nothing is free in life and the more the hype of anything, the more there will be loopholes and technicalities that will abound
the reason why advertising has gotten so outrageous and loud is the public has a very short attention span and thus skip plain commercials with regularity. the other aspect is that you the potential home buyer must be aware of all aspects of financing , you simply cannot trust who is trying to sell you something unless you do your research in advance.
car salesman, insurance salesman and mortgage brokers have a well deserved reputation for legal deception and tricks in order to get that sale, keep in mind they are not your friends, they are not doing you a favor, and the harder they push the more you must realize they are out for a commissioned sale, so plan accordingly
well they probley are not allowed to but who is going to stop them? they just might get a warning. they could also have a catch. they say they will finace you gaurantee, cause they can. its just you might have to put $100 down or $50,000 down. you could get what ever you want when you have a big chunk of money. your interest rate will be higher also. you dont want that. if you go again ask them not to shootgun your credit so it only takes off points you know about.
I was watching a commercial for DITECH lenders(a GMAC company) and they were advertising a rate around 5.69 to 5.85% but when I froze the screen on my tivo I read the fine print.the funny thing is that if I wasn't able to freeze the screen and read the fine print, that is about 3 paragrapghs , in the 5 second time frame that they give you to read it. I would have been calling them./ But as I read it, it was for a loan for in the amount of 250,001 to 430,000$. So basically they are not false advertising they are just not giving you all the facts up front. And yes they can get away with it.They have been doing it for years.They have loopholes for every possible scenario. SADLY........And when they say guaranteed they are implying that you meet all of their criteria. THUS the fine print.So to conclude . If it sounds to good to be true it usually is............. We are in the process of buying a home so I feel your frustration......... Good Luck ........
