In order to collect money from Nintendo, you'd have to prove your damages. What harm or monetary loss came your way because you couldn't download an outfit?!

Hire a local atty, give him the details and determine what damages you are due. Be prepared to spend a fortune

It depends on what you want to accuse them of falsely advertising...
You have to hire an attorney who has to determine if you have a viable case...if this has to do with a product being issued/released late, etc. they will LAUGH at you. Nintendo is a multi-billon dollar company. If you are a teenager who is unhappy that something didn't perform properly or to your expectations and it is something that they put in writing that their program could do and didn't, well you MIGHT have a case, but if it is because they had posters in Game Stop which said ';Coming Jan. 2008 and it didn't show up on shelves, there are a lot of people in between Nintendo and Game Stop. Just be patient and wait it out...
To the asker, that is Toys R US's review... I would bring it up with the person who wrote the review... (which may have been written before a product release). The game ( which I don't have and do not own a Wii), was released Feb.5th according to some very reputable sources, and many of these state that the downloads are just not available YET...

First of all. Before any ad leaves the desk of Nintendo inc., the ad is vetted by corperation Lawyers and Management clear it before they give it the green light. Your chances of anything positive coming out of your suit is 1000 to 1 odds. You will spend a kings ransome in court and end up in debt to pay the legal bills. I'd forget it and keep my day job if I were you.
