Okay, so what if you see an ad for an MP3 player that says it's the 8GB model and it costs $179.99, but above it they show the 80GB model?
Isn't that misleading, so that you'll think you're getting this MP3 player with a big huge screen that's shown in the picture, but they're really advertising the 8GB?
And if this IS false advertising, what can I do about it? how can I fight it?Would this be considered false advertisement?
If the writing in the ad specified the 8GB model than I wouldn't really say it was false advertising. If they didn't specify what model the price was for then you may have an argument. Sometimes if there is not a photo available of the actual product and they may just have a ';generic'; photo of any MP3 player for the sake of having a photo in the ad.Would this be considered false advertisement?
Look, the signage was obviously not mis-leading -- you figured it out. You are talking about price signage not advertising, and the sign clearly states which product is for sale at that price. There is nothing you can do. If you think it was meant to mislead, then don't shop at that store anymore.
Picture aside it was probably a misprint. If they specify in the write up 8 GB and deliver that then no, it is not false advertising.
